By confirming an order, the customer declares that they have read and accepted all of these terms and conditions of sale.
The trademarks, logos, and other distinctive signs displayed on the Website are the property of their respective owners. Any use of such distinctive signs without authorization, including reproduction on other websites, is prohibited.

3. Scope of Application

These conditions govern purchases made through the KIOO website. Each order placed constitutes a sales contract between the customer and the company, in accordance with the terms set out herein, valid at the time of order confirmation.

The purchase of Products on the Website is permitted only to individuals who are at least 18 years old at the time of ordering. By purchasing, the Customer confirms that they are of legal age. Otherwise, KIOO will not accept the order.

Before completing a purchase, the Customer must carefully read the General Terms and Conditions of Sale and accept them by clicking the order confirmation button. The purchase implies automatic acceptance of these conditions, including those referenced via links.

The General Terms and Conditions of Sale are available in the “Terms and Conditions” section of the Website and may be saved or printed.
The applicable General Terms and Conditions of Sale are those in force at the time the order is submitted. KIOO reserves the right to modify them at any time; changes shall take effect upon publication on the Website.

4. Prices and Product Features

Prices are expressed in euros and include VAT. Shipping costs are excluded and will be specified before payment confirmation.

For shipments to European Union member countries, any customs duties or import taxes shall be borne by the recipient and must be paid upon delivery.

Technical specifications and product images are provided by the respective manufacturers and may be subject to change. Photographs are for illustrative purposes only and may not accurately represent the actual product.

The customer is responsible for choosing the product that best suits their needs.

5. Order Submission and Invoicing

To purchase products on the website, registration is required. Purchases may be made by both consumers and non-consumer customers.

Pursuant to Article 3, paragraph 1, letter a) of the Italian Consumer Code, a “consumer” is a natural person who purchases goods for purposes unrelated to any professional activity. Entering a VAT number during purchase indicates a professional or commercial purpose.

In accordance with Legislative Decree No. 70 of April 9, 2003, Customers are informed that:

To purchase one or more Products on the Website, the Customer must complete an electronic order form following the provided instructions. Before submitting it, the Customer must accept the General Terms and Conditions of Sale.
After completing the order, KIOO will send an order confirmation email containing a summary of the General Terms and Conditions of Sale, the characteristics of the purchased product, the price, the payment method, delivery costs, and any additional charges.

Each order submitted through the Website constitutes a purchase proposal by the customer. Order confirmation by KIOO constitutes acceptance and finalizes the contract.

The invoice (if requested) is issued at the time of shipment. The customer must provide accurate billing details and delivery address.

The order form will be stored in KIOO’s database for the time necessary to process the order and in compliance with applicable regulations. The Customer may access their order through their personal account.

6. Order Processing Times and Management

Orders are processed according to the timelines indicated on the product page. An order may be canceled within 24 hours of confirmation. After this period, payment is considered binding.

If an item is unavailable, the customer will be informed. As an alternative to delayed delivery, the customer may choose a full refund or an alternative product.

7. Order Confirmation and Acceptance

An order is considered accepted only after written confirmation is sent by KIOO. This confirmation will include all details regarding products, prices, shipping times, and costs.

The company reserves the right to refuse orders in the event of technical errors, availability issues, or inconsistencies in the data provided.

8. Shipping and Delivery

Shipments are made by courier after payment confirmation. In the case of bank transfer, shipment will occur only after actual receipt of payment and completion of the production process.

Delivery times in Italy: within 60 working days from shipment.
For shipments to Sicily, Calabria, and Sardinia, delivery times may be slightly longer than those indicated on the Website.

For products with different availability times, the longest delivery time shall apply.

Delays of less than 30 days do not entitle the customer to cancel the order or claim compensation. Goods may also be shipped in multiple deliveries.

9. Delivery Method

Standard delivery is made at street level. Collection of used products is not provided.

10. Checks Upon Delivery

The customer is responsible for immediately checking:

• the number of packages received
• the condition of the packaging
• any visible damage

If anomalies are noted, they must be indicated on the courier’s delivery document before signing. Without written reservations, it will not be possible to contest visible damage later.
Any discrepancies must be reported within 24 hours of delivery.

11. Non-Delivery or Errors

If the recipient is not present, the courier will leave a notice for collection. If the goods are not collected within the specified timeframe, they will be returned to the sender, and only the product cost will be refunded, excluding shipping costs.

In the event of delivery errors (incorrect or defective product), the customer has 7 days to return the item. Upon receipt, KIOO will send the correct product at no additional cost.

12. Force Majeure

Extraordinary events such as strikes, transport disruptions, technical failures, or connection issues may prevent or delay delivery. In such cases, the order will be temporarily suspended.

If the situation persists for more than 90 days, the order may be canceled by either party.

13. Warranties and Assistance

KIOO guarantees that products arrive intact and conform to their description. Any visible defects must be reported within 10 days of receipt.

In such cases, a replacement will be provided at no additional cost.

Additional warranties are handled directly by the manufacturer, according to the procedures indicated in the accompanying documentation.

Any liability of KIOO, if established, shall not exceed the value of the purchased product.

14. Right of Withdrawal

Private customers (non-professionals) may cancel the order within 14 days of delivery, without providing reasons and without penalties.

To exercise this right, it is sufficient to send a written notice (including by email), stating the reason. The customer may request a standard withdrawal form.

If assembly is carried out independently, returns are not permitted.
KIOO declines all responsibility for any damage or malfunctions resulting from use in such circumstances.

Refund conditions:

• Full refund, including standard shipping costs
• Refund issued within 14 days of notification, but may be withheld until the products are returned
• Refund will be made using the same payment method used for the purchase

Return conditions:

• Products must be returned within 14 days
• Return shipping costs are borne by the customer
• Items must be intact, clean, and resalable

Exclusions from the right of withdrawal:

• Customized products
• Failure to comply with the above conditions

15. Payments

Accepted payment methods include:

• Credit cards
• Bank transfer (payment must be made within 14 days)
• Instant bank transfer
• PayPal, Stripe, Google Pay, Apple Pay

The customer guarantees that they have the right to use the selected payment method. In the event of non-payment, the order will be canceled and the products will not be shipped.

16. Prices

Delivery costs, which vary depending on the shipping method, location, and quantity, will be displayed on the product configuration page, in the order summary, and in the order confirmation email.

KIOO reserves the right to change prices at any time. However, the price applied to the Customer will be the one indicated on the Website at the time of the order, regardless of any subsequent changes.

17. Retention of Title

Until full payment of the order has been made, the goods remain the property of KIOO. In the event of non-payment, the company has the right to request their return at the customer’s expense.

18. Complaints

Any anomalies or non-conformities must be reported in writing within 7 days of delivery. Customers are advised to retain packaging and documents until the issue is resolved.

19. Privacy and Personal Data

Customer data is used exclusively for order management, invoicing, and any applicable warranties, in compliance with current legislation. Data may be shared only with partners involved in the sales and delivery process.

The customer may request access to, modification of, or deletion of their data at any time by contacting privacy@kiooshop.it.

20. Jurisdiction

These General Terms and Conditions of Sale are governed by Italian law and subject to Italian jurisdiction. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
For disputes relating to the validity, execution, or interpretation of these Terms, the competent court shall be the Court of Treviso.
